The Business has completed the following service(s) in full for the Client, as agreed upon: Cake, Cupcakes and Bars Terms and Conditions1.2. Project description
The Client is hiring the Business to do the following: Retainers, Deposits, Payments & Taxes 1. The date of the event is considered “booked” upon receipt of the total value of the cake, cupcakes or bars, delivery charges . 2. The final payment is due immediately upon order before pickup or delivery. 3. If the Client fails to make payments, TreatsPhoria Baked Goods and Sweets (herinafter will be named “TreatsPhoria”) will cease work, the order will be cancelled and no refund will be given. 4. Preferred methods of payment are CREDIT OR DEBIT CARD 5. Late payments will be charged a $20 fee. 6. Returned checks and surcharges will be charged a $35 fee. 7. Your order becomes reserved only when the order is made and the payment has been received. The retainer (50%) is paid to reserve your date and/or time and is NON-REFUNDABLE in the event of a cancellation. Our goods are first come first serve and we only do a limited number of items per week. However, if you need to change dates or move your event, please call us and we’ll be happy to make accommodating arrangements. 8. In the event of a nation-wide or "state of emergency," that causes events to be canceled or postponed by you or the event coordinator, we will allow rescheduling of the date within 6 months of the event date and based on our calendar availability. No refunds are allowed, however, you will not have to pay a new retainer. There is no penalty or extra fees unless there is a desire to upgrade or increase the original products paid for. Liability 1. TreatsPhoria is not responsible for bodily injury, property or consequential damage, which may result from services. 2. TreatsPhoria is not responsible for any damage to the baked goods or shortage of baked goods caused by anyone NOT employed by TreatsPhoria. 3. TreatsPhoria is not responsible for any injuries, illnesses, or damages done from the use of dowels, luster dust, or any other edible or non-edible items that may be inside or outside of the baked goods. Fulfillment of Contract 1. TreatsPhoria is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond TreatsPhoria’s control. 2. If TreatsPhoria has completed the baked goods but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 100% of the total cost. TreatsPhoria cannot be held liable for more than the cost of the above ordered baked goods. 3. If Client picks up the baked goods, TreatsPhoria no longer assumes any responsibility for damage caused to it. Postponement/Cancellation 1. The Client must notify TreatsPhoria if there is a change in the date of the event or a complete cancellation. 2. If the postponement occurs before 3 days of the event, no penalty fee will be charged. 3. If the postponement occurs 3 days prior to the event, the Client will be charged a $30 fee. 4. If a cancellation occurs 7 days prior to the date of the event, all money will be refunded minus the retainer fee. Changes to Order 1. Any changes must be submitted 3 days in advance. 2. Changes are subject to extra fees that are dependent on the changes being made. 3. There will be no changes allowed 3 days prior to the event. Design of the Cake 1. TreatsPhoria will follow the Client’s requests closely to create the exact cake desired. 2. TreatsPhoria cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar. 3. All copyrighted or trademarked designs will not be made due to copyright laws. Serving Amount & Sizes 1. Serving size estimations are not guaranteed to be exact. 2. TreatsPhoria is not responsible for a shortage of baked goods if the pieces are cut too large. Allergy & Dietary Warnings/Care of Baked Goods 1. TreatsPhoria’s baked goods may have come in contact with the following ingredients: • Wheat • Eggs • Dairy • Nuts • Red Food Coloring • Natural dyes, artificial dyes, artificial flavorings, cocoa or chocolate, sugar, artificial sweeteners, artificial colors and other allergens not listed. 2. The Client is responsible for pointing out to guests potential allergy hazards. 3. Buttercream cakes and cupcakes are best kept refrigerated until 30 minutes and whipped cream cakes and cupcakes are best kept refrigerated until 15 minutes prior to the event to ensure the icing/topping does not melt. Photographs TreatsPhoria reserves the right to use all photographs of any of the baked goods for advertising purposes.The Client hereby acknowledges that all Business services were provided as agreed upon and as described, with no issues identified upon completion.
